Effective Date: November 2024<\/span><\/i><\/p>

This End User License Agreement (“EULA”) is a legally binding agreement between you (“User”) and Wonderia (trade name pending) (“we,” “us,” or “our”) regarding your use of the content, downloadable resources, stories, and other materials (“Resources”) available on gowonderia.com (the “Site”). By accessing or using the Resources, you agree to the terms of this EULA.<\/span><\/p>

1. Introduction & Scope<\/b><\/h4>

Wonderia provides educational products and Resources designed to inspire creativity and learning in children. This EULA explains your rights and restrictions regarding the use of these Resources. If you do not agree to these terms, please discontinue use of our Resources immediately.<\/span><\/p>

2. Grant of License<\/b><\/h4>

Wonderia grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Resources for your personal, non-commercial purposes only. This license cannot be transferred or sublicensed to anyone else. Any attempt to transfer the rights granted here will not be allowed and will void this Agreement.<\/span><\/p>

Access to Resources may require a valid, active, and compliant account on the Site. Wonderia reserves the right to amend or limit access, especially if Resources move to a paid format. We will notify you at least 30 days in advance if any previously free Resources become paid.<\/span><\/p>

3. Permitted Uses<\/b><\/h4>
  • Personal Use Only<\/b>: You may use the Resources strictly for your personal enjoyment.<\/span><\/li>
  • Printing and Sharing Limitations<\/b>: You are allowed to print Resources for your personal use. Sharing, redistributing, or reselling Resources\u2014including sharing with friends or family\u2014is prohibited without explicit written permission.<\/span><\/li>
  • Requests for Permissions<\/b>: If you wish to use the Resources in a way not covered by this license, such as for educational or public purposes, please contact us at support@gowonderia.com. You can expect a response within 14 business days.<\/span><\/li><\/ul>

    4. Restrictions on Use<\/b><\/h4>

    The following uses are prohibited:<\/span><\/p>

    • Modification and Adaptation<\/b>: You may not modify, translate, or create derivative works based on our Resources without prior written permission from Wonderia. Users may create custom cards or materials compatible with Wonderia products like Wonderpad, but these must be solely for personal use and cannot be commercialized or publicly distributed.<\/span><\/li>
    • Redistribution or Sharing<\/b>: You may not redistribute, share, or copy the Resources without explicit authorization.<\/span><\/li><\/ul>

      5. Social Media and Public Use<\/b><\/h4>
      • Posting on Social Media<\/b>: You are allowed to post images or references to Wonderia Resources on social media, provided these posts are non-commercial, do not misrepresent Wonderia, and do not imply endorsement by Wonderia without permission. Example: You may post photos of yourself using Wonderia products, tagging our official handle (@gowonderia).<\/span><\/li>
      • No Commercial Use<\/b>: Any use of Wonderia Resources for commercial gain, such as influencer promotions or unauthorized public presentations, is strictly prohibited unless written permission is granted.<\/span><\/li>
      • Removal Requests<\/b>: Wonderia reserves the right to request the removal of any social media posts or public displays of the Resources that it believes misrepresent the brand or violate the terms of this Agreement.<\/span><\/li><\/ul>

        6. Duration and Termination<\/b><\/h4>

        This license is effective until terminated by either party. Wonderia may provide notice of license termination at its discretion, but reserves the right to terminate without notice in cases of significant or intentional violations. If you breach any part of this EULA or if Wonderia suspects you of violating our intellectual property rights, we may revoke your access immediately. Upon termination, you must delete all copies of the Resources in your possession.<\/span><\/p>

        7. Intellectual Property Rights<\/b><\/h4>

        All Resources, including stories, cards, characters, and other materials, are the exclusive property of Wonderia. This EULA grants you limited usage rights; it does not grant ownership. When sharing allowed content (e.g., social media posts featuring Resources), please credit Wonderia by tagging us or mentioning our name.<\/span><\/p>

        8. Reservation of Rights<\/b><\/h4>

        Wonderia may use digital watermarks or tracking tools to detect unauthorized use of our Resources. Circumventing, tampering with, or attempting to remove any digital watermarks or tracking tools that Wonderia may implement is strictly prohibited. Unauthorized uses may lead to immediate termination of your license and further legal action.<\/span><\/p>

        9. Disclaimer of Warranties<\/b><\/h4>

        Wonderia provides Resources “as is” and makes no warranties, express or implied, about their accuracy or suitability for specific purposes. We strive to deliver quality, but we cannot guarantee perfection.<\/span><\/p>

        10. Limitation of Liability<\/b><\/h4>

        To the maximum extent permitted by law, Wonderia disclaims liability for any incidental, indirect, or consequential damages. If any liability arises, it will be limited to the minimum extent required by law.<\/span><\/p>

        11. Legal Enforcement and Remedies<\/b><\/h4>

        Unauthorized use, modification, or distribution of Wonderia Resources may result in legal action under Spanish and EU law. This Agreement and any disputes arising from it are governed by the laws of Spain and the European Union. Any legal proceedings will take place in the jurisdiction of Spain, and Users waive any objections to such venue. Wonderia reserves the right to pursue all available remedies to protect our intellectual property.<\/span><\/p>

        12. Amendments to EULA<\/b><\/h4>

        We may update this EULA periodically. Changes will be posted on the Site, and your continued use of the Resources constitutes acceptance of these updates. We will strive to inform users through email or notifications on significant changes.<\/span><\/p>

        13. Acknowledgment of Privacy Policy<\/b><\/h4>

        Este Acuerdo de Licencia de Usuario Final (\u201cEULA\u201d, por sus siglas en ingl\u00e9s) es un acuerdo legalmente vinculante entre usted (\u201cUsuario\u201d) y Wonderia (nombre comercial pendiente) (\u201cnosotros,\u201d \u201cnos,\u201d o \u201cnuestro\u201d) en relaci\u00f3n con su uso de los contenidos, recursos descargables, historias y otros materiales (\u201cRecursos\u201d) disponibles en gowonderia.com (el \u201cSitio\u201d). Al acceder o utilizar los Recursos, usted acepta los t\u00e9rminos de este EULA.<\/span><\/p>

        1. Introducci\u00f3n y Alcance<\/b><\/h4>

        Wonderia proporciona productos y Recursos educativos dise\u00f1ados para inspirar creatividad y aprendizaje en los ni\u00f1os. Este EULA explica sus derechos y restricciones en relaci\u00f3n con el uso de estos Recursos. Si no est\u00e1 de acuerdo con estos t\u00e9rminos, por favor suspenda el uso de nuestros Recursos inmediatamente.<\/span><\/p>

        2. Concesi\u00f3n de Licencia<\/b><\/h4>

        Wonderia le otorga una licencia limitada, no exclusiva, no transferible y revocable para acceder y utilizar los Recursos \u00fanicamente para sus fines personales y no comerciales. Esta licencia no puede ser transferida ni sublicenciada a terceros. Cualquier intento de transferir los derechos concedidos aqu\u00ed ser\u00e1 considerado nulo y anular\u00e1 este Acuerdo.<\/span><\/p>

        El acceso a los Recursos puede requerir una cuenta v\u00e1lida, activa y en cumplimiento en el Sitio. Wonderia se reserva el derecho de modificar o limitar el acceso, especialmente si los Recursos pasan a un formato de pago. En caso de que Recursos previamente gratuitos pasen a ser de pago, le notificaremos con al menos 30 d\u00edas de antelaci\u00f3n.<\/span><\/p>

        3. Usos Permitidos<\/b><\/h4>
        • Solo para Uso Personal<\/b>: Puede utilizar los Recursos exclusivamente para su disfrute personal.<\/span><\/li>
        • Limitaciones de Impresi\u00f3n y Compartici\u00f3n<\/b>: Puede imprimir Recursos para su uso personal. Sin embargo, compartir, redistribuir o revender los Recursos \u2014incluido compartirlos con amigos o familiares\u2014 est\u00e1 prohibido sin permiso expl\u00edcito por escrito.<\/span><\/li>
        • Solicitudes de Permisos<\/b>: Si desea utilizar los Recursos de una manera no contemplada en esta licencia, como para fines educativos o p\u00fablicos, comun\u00edquese con nosotros en [informaci\u00f3n de contacto]. Puede esperar una respuesta en un plazo de 14 d\u00edas h\u00e1biles.<\/span><\/li><\/ul>

          4. Restricciones de Uso<\/b><\/h4>

          Los siguientes usos est\u00e1n prohibidos:<\/span><\/p>

          • Modificaci\u00f3n y Adaptaci\u00f3n<\/b>: No puede modificar, traducir ni crear obras derivadas basadas en nuestros Recursos sin previo permiso por escrito de Wonderia. Los usuarios pueden crear cartas o materiales personalizados compatibles con productos de Wonderia, como el Wonderpad, pero estos deben ser exclusivamente para uso personal y no pueden comercializarse ni distribuirse p\u00fablicamente.<\/span><\/li>
          • Redistribuci\u00f3n o Compartici\u00f3n<\/b>: No puede redistribuir, compartir ni copiar los Recursos sin autorizaci\u00f3n expl\u00edcita.<\/span><\/li><\/ul>

            5. Uso en Redes Sociales y P\u00fablico<\/b><\/h4>
            • Publicaci\u00f3n en Redes Sociales<\/b>: Se le permite publicar im\u00e1genes o referencias a los Recursos de Wonderia en redes sociales, siempre que estas publicaciones sean de car\u00e1cter no comercial, no tergiversen a Wonderia y no impliquen un respaldo de Wonderia sin permiso. Ejemplo: Puede publicar fotos de usted mismo usando productos de Wonderia, etiquetando nuestra cuenta oficial (@gowonderia).<\/span><\/li>
            • Sin Uso Comercial<\/b>: Cualquier uso de los Recursos de Wonderia con fines comerciales, como promociones de influencers o presentaciones p\u00fablicas no autorizadas, est\u00e1 estrictamente prohibido a menos que se otorgue permiso por escrito.<\/span><\/li>
            • Solicitudes de Eliminaci\u00f3n<\/b>: Wonderia se reserva el derecho de solicitar la eliminaci\u00f3n de cualquier publicaci\u00f3n en redes sociales o exhibici\u00f3n p\u00fablica de los Recursos que considere que tergiversa la marca o infringe los t\u00e9rminos de este Acuerdo.<\/span><\/li><\/ul>

              6. Duraci\u00f3n y Terminaci\u00f3n<\/b><\/h4>

              Esta licencia est\u00e1 en vigor hasta que cualquiera de las partes la termine. Wonderia puede notificar la terminaci\u00f3n de la licencia a su discreci\u00f3n, pero se reserva el derecho de terminar sin previo aviso en casos de violaciones graves o intencionales. Si usted infringe cualquier parte de este EULA o si Wonderia sospecha que est\u00e1 violando nuestros derechos de propiedad intelectual, podemos revocar su acceso de inmediato. Al terminarse el acuerdo, deber\u00e1 eliminar todas las copias de los Recursos que tenga en su posesi\u00f3n.<\/span><\/p>

              7. Derechos de Propiedad Intelectual<\/b><\/h4>

              Todos los Recursos, incluidas historias, cartas, personajes y otros materiales, son propiedad exclusiva de Wonderia. Este EULA le otorga derechos de uso limitado; no le otorga derechos de propiedad. Cuando comparta contenido permitido (por ejemplo, publicaciones en redes sociales que incluyan Recursos), le solicitamos que d\u00e9 cr\u00e9dito a Wonderia etiquet\u00e1ndonos o mencionando nuestro nombre.<\/span><\/p>

              8. Reserva de Derechos<\/b><\/h4>

              Wonderia puede utilizar marcas de agua digitales u otras herramientas de seguimiento para detectar el uso no autorizado de nuestros Recursos. Est\u00e1 estrictamente prohibido eludir, manipular o intentar eliminar cualquier marca de agua digital o herramienta de seguimiento que Wonderia pueda implementar. Los usos no autorizados pueden resultar en la terminaci\u00f3n inmediata de su licencia y en acciones legales.<\/span><\/p>

              9. Exenci\u00f3n de Garant\u00edas<\/b><\/h4>

              Wonderia proporciona los Recursos \u201ctal cual\u201d y no ofrece garant\u00edas, expresas o impl\u00edcitas, sobre su exactitud o idoneidad para fines espec\u00edficos. Nos esforzamos por ofrecer calidad, pero no podemos garantizar la perfecci\u00f3n.<\/span><\/p>

              10. Limitaci\u00f3n de Responsabilidad<\/b><\/h4>

              En la medida m\u00e1xima permitida por la ley, Wonderia se exime de responsabilidad por cualquier da\u00f1o incidental, indirecto o consecuente. Si surge alguna responsabilidad, esta se limitar\u00e1 al m\u00ednimo requerido por la ley.<\/span><\/p>

              11. Ejecuci\u00f3n Legal y Recursos<\/b><\/h4>

              El uso, modificaci\u00f3n o distribuci\u00f3n no autorizada de los Recursos de Wonderia puede resultar en acciones legales conforme a las leyes de Espa\u00f1a y de la UE. Este Acuerdo y cualquier disputa que surja del mismo se regir\u00e1n por las leyes de Espa\u00f1a y la Uni\u00f3n Europea. Cualquier procedimiento legal se llevar\u00e1 a cabo en la jurisdicci\u00f3n de Espa\u00f1a, y los Usuarios renuncian a cualquier objeci\u00f3n a dicha jurisdicci\u00f3n. Wonderia se reserva el derecho de buscar todos los recursos disponibles para proteger su propiedad intelectual.<\/span><\/p>

              12. Modificaciones al EULA<\/b><\/h4>

              Podemos actualizar este EULA peri\u00f3dicamente. Los cambios se publicar\u00e1n en el Sitio, y el uso continuo de los Recursos constituye la aceptaci\u00f3n de dichas actualizaciones. Nos esforzaremos por informar a los usuarios a trav\u00e9s de correo electr\u00f3nico o notificaciones en caso de cambios significativos.<\/span><\/p>

              13. Reconocimiento de la Pol\u00edtica de Privacidad<\/b><\/h4>
